BALTIMORE — U.S. Immigration and Customs Enforcement (ICE) has detained Kilmar Ábrego García, a Salvadoran national whose earlier deportation was deemed unlawful by multiple federal courts. The arrest, which took place Monday at ICE’s Baltimore field office, has reignited concerns over executive compliance with judicial mandates.
Ábrego García was previously deported in March despite a standing court order prohibiting his removal. That action was later overturned, and a federal judge ordered his return to the United States in June. Judge Paula Xinis of the U.S. District Court for the District of Maryland described the deportation as “wholly lawless” and instructed the government to actively facilitate his repatriation.
Following failed appeals to the Fourth Circuit and the Supreme Court, Ábrego García reentered the country to pursue legal claims. However, ICE detained him again during a scheduled check-in, prompting his attorneys to file for emergency relief. The Department of Homeland Security (DHS) issued a press release alleging ties to criminal activity, though no formal charges have been substantiated.
Ábrego García also faces a separate criminal case in Tennessee, where his legal team has accused federal prosecutors of coercion, citing threats of deportation to Uganda—a country with which he has no ties—as leverage for a guilty plea.
Judge Xinis has since ordered that Ábrego García remain in the U.S. while she reviews the legality of the government’s renewed deportation efforts.
